Service Terms
You should carefully read the following Service Terms before using GigIreland.
By using GigIreland or indicating your agreement in the introductory screen,
you are indicating your acceptance of these Service Terms, and will thus create a
legally binding agreement. If you do not agree with the Service Terms you should
not use GigIreland and you should request disconnection of your GigIreland account
(if any) forthwith.
ACCESS & PARTIES
GigIreland service:
GigIreland agrees to provide you access to the GigIreland Site in accordance with
these Service Terms. Browsing of GigIreland.com is provided free of charge for
personal use and may not be resold. Registering and submitting Gig Listing for
Bands or Venues may incur a charge that can be set or change by GigIreland at any time.
Username/Password
Upon registration your Band or Venue, you will receive a username and password.
You understand that you are solely responsible for maintaining the confidentiality of
your password, and that you shall be solely and fully responsible for all activities
that occur under your handle and password. GigIreland shall not be responsible for any
loss, claim or other liability that may arise from the unauthorized use of any password.
If a password is lost or stolen it is the user's responsibility to notify GigIreland, so
that the missing password can be deactivated and a new one assigned.
Access:
You are responsible for providing and maintaining all personal computer and
communications equipment and Internet access accounts necessary to gain access
to the GigIreland service.
Eligibility to use GigIreland service:
Persons under the age of 18 are not allowed to subscribe to or use the GigIreland service.
Portions of the GigIreland service may not be suitable for children.
USER RESPONSIBILITIES
Use by Third Parties:
You are responsible for the use of your account by anyone else using your account,
and for ensuring that any user of your account fully complies with the Service Terms.
Responsibility for Postings:
You will not post any defamatory, inaccurate, abusive, profane, sexually orientated,
threatening, racially offensive or illegal materials on the GigIreland site; nor shall
you encourage the use of controlled substances or encourage other illegal activity.
You specifically agree that GigIreland will not be responsible for any such material
published by you or received by you and you fully release and indemnify GigIreland
from all liability and responsibility for any such transmissions, publications or receipt.
We reserve the right to edit, move, or delete any of your content for any reason.
Responsibility for Communications Received:
You are responsible for any communications, messages and other information that
you receive, and bear the entire responsibility for any losses that you may experience,
as a result of your use of the GigIreland service.
Copyright Material:
In addition you agree not to post any information or other material
protected by copyright without permission of the copyright owner. By posting any
material the posting party warrants and represents that it owns the copyright with
respect to such material or has received permission from the copyright owner.
You agree that any posting party grants GigIreland the non-exclusive right and licence
to display, copy, publish, distribution, transmit, print and use such information or
other material.
Legal compliance:
You agree to use GigIreland in a manner consistent with any and all applicable laws,
rules and regulations.
SECURITY & CONFIDENTIALITY
Security Breaches:
You agree to inform GigIreland at the earliest possible opportunity of any apparent
breaches of security such as loss, theft or unauthorised disclosure or use of an ID
or password. Until GigIreland is so notified you will remain liable for any
unauthorised use of your GigIreland account.
Confidentiality:
You accept that the GigIreland site and service is not secure or confidential.
While GigIreland will not intentionally inspect the contents of your transmissions
we reserve the right to co-operate fully with officials in any legally authorised
investigation concerning or relating to any transmissions transmitted via the GigIreland service.
Sensitive Information:
The GigIreland service may contain information that is price sensitive with respect to
publicly quoted companies. Anyone dealing in securities using information contained
on the GigIreland Site may be guilty of insider trading.
NO GIGIRELAND LIABILITY FOR CONTENT
General:
GigIreland accepts no responsibility for the opinions and information posted
on the site by others. GigIreland disclaims all warranties and excludes all
liability with regard to information posted on the site, whether posted by
GigIreland or any third party. This disclaimer includes all implied warranties
of merchantability, satisfactory quality and fitness for purpose.
Inappropriate Material:
GigIreland cannot and does not actively monitor the service for inappropriate
postings and does not on its own undertake editorial control of postings.
However, in the event that any inappropriate posting is brought to GigIreland's
attention, GigIreland will take all appropriate action to edit, purge or if necessary,
remove the same.
WARRANTY & WARRANTY LIMITATIONS
No Warranty:
You accept that computer systems are regularly unavailable due to routine maintenance
that they sometimes break down, and that user access can be delayed due to a
variety of technical reasons. As a result, you accept that GigIreland cannot
guarantee access at any particular time and that in general the GigIreland service
is provided on an "as is, as available" basis. Exclusion of Implied Warranties:
GigIreland disclaims all implied warranties or merchantability, satisfactory quality
and fitness for purpose with regard to the GigIreland service and the entire risk as
to the quality performance and use of the service is with you. Some jurisdictions do
not allow the exclusion of implied warranties so the above exclusions may not apply to you.
Your statutory rights as a consumer (if any) are not affected.
General User Indemnity
You and not GigIreland are responsible for your behaviour and the behaviour of those
who use your service account. If you violate the restrictions in these Service Terms
you agree to indemnify GigIreland for any losses, costs or damages including reasonable
lawyer's fees incurred by GigIreland in relation to or arising out of such a breach.
GENERAL LIABILITY OF GIGIRELAND
Exclusive Remedy:
You accept that your sole remedy for breach by GigIreland of any provisions of these
Service Terms shall be termination by you of your account (if any) with GigIreland.
Exclusions of Liability:
In no event shall GigIreland be liable for any special indirect or consequential
damages or any damages whatsoever resulting from loss of use, data, profits or anticipated
savings arising out of or in connection with the use or performance of any information
posted on the GigIreland Website, or any aspect of the GigIreland service.
Termination
Your access to and use of the GigIreland service may be terminated at any time for any
reason or for no reason by you or by GigIreland by the sending of notice to the other party.
MISCELLANEOUS
Force majeure:
Neither party will be responsible for breach of these Service Terms due to
circumstances beyond its reasonable control.
Entire Agreement:
These terms contain the entire understanding between us with respect to the
GigIreland service and no representation, statement, inducement oral or written,
not contained herein shall bind either of us. In agreeing to this provision
neither party attempts to exclude liability for fraud.
Severability:
Should any part of these terms for any reason be declared invalid by a court of
competent jurisdiction, such determination shall not affect the validity of any
remaining portion and such remaining portion shall remain in full force and effect
as if the invalid portion of these terms had been eliminated.
Law & Disputes:
You agree that the courts of Ireland shall have exclusive jurisdiction to resolve
any controversy or claim of whatever nature arising out of or relating to the
GigIreland service, and that the laws of Ireland shall govern such controversy or claim.
